No. In a public place it does not apply in my opinon. Look any any street photography blog or website, or even Government tourist websites, or newspaper photos of streets of sports stadium. Pictures of anonymous people in public places are very often used. In a public place the artist (or photographer) has a right to perform his art. Do you have a different opinion?
